Welcome to Thingster! These Terms of Service ("Terms") govern your access to and use of the Thingster website (thingster.app), applications, RSS and podcast feeds, embed widgets, APIs, and related services (collectively, the "Service"), provided by Thingster ("we", "us", or "our").

Please read these Terms carefully before using Thingster. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility & Account Registration

To use Thingster, you must be at least 13 years old (or the minimum legal age in your country to consent to online services). By creating an account or using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

When registering, you agree to provide accurate information and keep your credentials secure. Thingster provides passwordless authentication with Passkeys (WebAuthn / FIDO2). You are responsible for maintaining the security of your authentication devices and passkeys and for all activity that occurs under your account. You must notify us immediately of any unauthorized use or security breach.

2. User Content & Intellectual Property Rights

  • You Own Your Content: You retain full ownership, copyright, and any other proprietary rights in all text, articles, audio, video, images, comments, and other material you publish or upload to Thingster ("User Content" or "Things").
  • License to Thingster: By publishing or uploading User Content to or through the Service, you grant Thingster a worldwide, non-exclusive, royalty-free, transferable license (with the right to sublicense) to host, store, cache, reproduce, format, distribute, display, and perform your content solely as necessary to operate, provide, maintain, and promote the Service. This includes generating RSS podcast feeds, displaying embeds on external sites as authorized by you, and adapting media for proper playback across devices.
  • Your Representations: You represent and warrant that you own or have obtained all necessary licenses, rights, consents, and permissions to publish your User Content and that your content does not violate any third-party intellectual property, privacy, or publicity rights.

3. Acceptable Use & Conduct

You agree to use Thingster responsibly. You agree that you will not:

  • Post content that is illegal, defamatory, libelous, harassing, threatening, abusive, or promotes violence or hatred against individuals or groups.
  • Upload malware, viruses, worms, Trojan horses, or any harmful code intended to disrupt or damage software, hardware, or networks.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to Thingster.
  • Impersonate any person, business, or entity, or falsely claim an affiliation that does not exist.
  • Engage in abusive automated data scraping, harvesting, or denial-of-service attacks that impair system availability or performance.
  • Interfere with or circumvent any security measures, rate limits, or access controls.

We reserve the right to review, flag, filter, or remove any User Content and suspend or terminate accounts that violate these rules.

4. Monetization, Paywalls & Payments

Thingster provides features that allow creators to monetize content, such as paywalling specific posts or accepting payments.

  • Payment Processors: Transactions may be handled via payment processors (such as Stripe Connect) or decentralized blockchain networks (such as stablecoin transactions). By using monetization features, you agree to comply with the respective processor's terms and conditions.
  • Blockchain Transactions: Any transactions executed on a blockchain are irreversible once confirmed by the network. You are responsible for any applicable network gas or transaction fees and for ensuring the accuracy of recipient wallet addresses.
  • Fees: Thingster may charge platform fees on paid transactions or premium subscriptions, as communicated on our pricing and feature pages.
  • Taxes: Creators are solely responsible for determining, collecting, reporting, and remitting any applicable taxes associated with payments received through the Service.

5. RSS Feeds, Podcasts & Embeds

Thingster makes it easy to distribute your audio, video, and text content through automated RSS podcast feeds and embed widgets. You acknowledge that public RSS feeds and embeds are accessible by third-party aggregators, podcatchers, and website owners, and Thingster does not control how external applications cache or render publicly syndicated feeds.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THINGSTER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THINGSTER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA.

8. Termination

You may stop using Thingster and close your account at any time. We reserve the right to suspend or terminate your account or access to the Service at our sole discretion, without prior notice, if we believe you have violated these Terms or applicable law, or if necessary to protect the integrity and security of the Service and its community.

9. Changes to Terms

We may revise these Terms from time to time. When changes occur, we will post the revised Terms on this page and update the "Last updated" date. If a change is material, we will provide reasonable advance notice. Your continued use of the Service following the posting of updated Terms constitutes your agreement to the new Terms.
